In a significant development, Chief Justice Olukayode Ariwoola disclosed that the Supreme Court is on the brink of a historic transformation, set to elevate its number of justices to the constitutionally-prescribed 21. This decision comes as a rescue mission following a spate of retirements that dwindled the number of Justices to an unprecedented low of 10.
Speaking during the inauguration of 58 new Senior Advocates of Nigeria (SANs) at the commencement of the 2023/2024 legal year at the Supreme Court Complex, Justice Ariwoola highlighted the urgent need to restore the Supreme Court to its full strength. He revealed that efforts to achieve the mandated 21 Justices, initiated by his predecessor, faced initial setbacks but have now gained momentum since his assumption of office in June 2022.
Expressing his determination, the CJN assured the litigant public of the imminent realization of a complete bench of 21 Justices at the Supreme Court. He emphasized the symbolic importance of this achievement, stating, “That is one of the legacies I have been working assiduously to leave behind as it now seems that the Court has been somewhat ‘jinxed’ from meeting its Constitutional requirement since that piece of legislation was enacted several years ago.”
Justice Ariwoola also underscored the critical need to fortify the judiciary’s independence, advocating for statutory protection at both Federal and State levels. He articulated, “The rule of law and the holistic independence of the judiciary should always be cherished by all. As the Chief Justice of Nigeria, I will do everything within my ability to make it remain part of my responsibility to nourish.”
Furthermore, the CJN pledged to enhance public trust and confidence in the judiciary, emphasizing the judiciary’s pivotal role in upholding the rule of law and constitutional principles. He urged Judicial Officers to uphold integrity and impartiality, stating, “Be bold in all your judgments by deciding cases without fear or favour, because fear and favour come in many hues and colours.”
Reflecting on the Apex Court’s performance in the last year, Justice Ariwoola provided a comprehensive overview of the cases handled, affirming the Court’s commitment to effective justice delivery. He also admonished the new SANs to uphold integrity and restrain from unnecessary litigious tendencies, promoting the use of alternative dispute resolution mechanisms to alleviate the burden on the courts.
Concluding his address, the CJN emphasized the need for a shift in attitudes towards legal processes, advocating for a focused and transparent application of the law. He reaffirmed the importance of adhering to the laws of the land and cultivating a culture of integrity and humility among legal practitioners.
