Court Strikes Down Governor’s Directive in Alleged Murder Case, Awards N25m Damages

In a landmark ruling, the Federal High Court in Abuja has overturned the directive of Governor Abba Yusuf of Kano State, relating to the alleged murder case involving Rep Alhassan Doguwa (APC-Kano), and has ordered the payment of N25 million in damages.

Mr. Doguwa, the representative of Doguwa/Tundun Wada Federal Constituency of Kano State, was arrested on February 28 at the Mallam Aminu Kano International Airport while boarding a flight to Abuja. The police had accused him of leading thugs to set ablaze the secretariat of the New Nigeria People’s Party (NNPP) in Kano, an incident in which two individuals reportedly lost their lives. Despite denying any wrongdoing, Doguwa was arraigned in March at a magistrate court in Kano and remanded in prison. He was later granted bail by a Federal High Court in Kano after the charges were withdrawn due to insufficient evidence linking him to the alleged offenses.

Subsequently, the lawmaker filed a lawsuit seeking to enforce his fundamental rights amidst concerns of a potential re-arrest. The suit named the Attorney-General of the Federation, the Inspector-General of Police, the Executive Governor of Kano State, and the State Attorney-General as defendants.

Justice Donatus Okorowo has now ruled in favor of Mr. Doguwa, denouncing the governor’s attempt to review the legal advice and ordering an end to any interference with the legislator’s fundamental rights. The judge also awarded N25 million in damages against Governor Yusuf, citing the psychological pain and damage inflicted upon Mr. Doguwa.
