Court Set to Rule on Suspended CBN Governor Emefiele’s Human Rights Case on January 8

The suspended governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, is eagerly anticipating the ruling of Justice Olukayode Adeniyi of the Federal Capital Territory High Court on January 8. This date has been fixed for the delivery of judgement in the enforcement of a fundamental rights suit filed by Emefiele.

The case marked FCT/HC/CV/040/2023 has captured considerable attention as the embattled Emefiele took legal action against the Federal Government, the Attorney-General of the Federation, the chairman of the Economic and Financial Crimes Commission (EFCC), and the commission. Emefiele seeks to enforce his fundamental rights to life, personal liberty, a fair hearing, and freedom of movement.

Emefiele has specifically highlighted his prolonged detention by the agency of the first and second respondents since June 10, 2023, and subsequent transfer to the custody of the third and fourth respondents on October 26, 2023, without being arraigned in court. This, he contends, contravenes his rights as safeguarded by the 1999 Constitution of Nigeria (as amended) and the African Charter on Human and Peoples’ Rights.

The case has garnered further intensity as Emefiele also pursues an injunction restraining the respondents from arresting or detaining him without proffering a criminal charge against him. In addition, he seeks damages in the amount of N1 billion for the violation of his fundamental rights.

With the impending judgement, all eyes are on the Federal Capital Territory High Court as it navigates this significant legal matter.
