Kano Electricity Distribution Company Urges Manufacturers to Settle Dispute Peacefully

The Kano Electricity Distribution Company (KEDCO) has appealed to the Manufacturers Association of Nigeria (MAN) and other aggrieved customers to settle their differences peacefully. This move comes after the company emerged victorious in a court battle against MAN and other plaintiffs who sought to halt the implementation of a tariff increase for Band A customers.

According to a press statement issued by KEDCO’s corporate communications head, Sani Bala, the company is calling for a round-table reconciliation with the aggrieved parties. The statement partly reads: “KEDCO is calling for a round-table reconciliation with the aggrieved parties after its triumph in court against MAN, Nigeria Association of Small-Scale Industrialists (Kano State Chapter), Tofa Textile Limited, Dala Foods Nig. Ltd., Mama Sannu Ind. Ltd., BBY Super Sack Ltd., and Super Sack Co. Ltd.”

The dispute centers around the April 2024 Supplementary Order on Band A tariff increase, which was implemented by KEDCO. However, the plaintiffs claimed that the order was discriminatory, unlawful, and unconstitutional. They sought to halt its implementation, but a Federal High Court in Kano dismissed the suit, ruling that the order was validly made in accordance with the Multi-Year Tariff Order 2024.

The presiding judge, Hon. Justice Simon Amobeda, dismissed the plaintiffs’ claims, stating that they failed to produce any cogent, credible, and convincing evidence to show that Band A customers were treated worse than other categories. Amobeda also upheld that the April 2024 Supplementary Order was validly made after stringent compliance with the provisions of section 116 (6), (7), (8), (9), and 10 of the Electricity Act.

Despite the court’s ruling, KEDCO has emphasized its commitment to supporting manufacturers with improved cost-efficient supply in the Kano DISCO franchise area. The company’s board and management have acknowledged the importance of manufacturers, promising to continue providing them with reliable and efficient electricity supply.

In light of the court’s decision, KEDCO is urging MAN and other aggrieved customers to consider a peaceful and amicable settlement of their differences with the company. By doing so, the company hopes to resolve the dispute and maintain a positive relationship with its customers.
