Unlawful Arrest and Detention: Anambra Businessman Seeks N20 Million Compensation

A businesswoman in Anambra State, Tochukwu Nwosu, has taken legal action against a police officer, CSP Ifeanyi Iburu, for unlawful arrest and detention. Nwosu was arrested on September 4, 2024, at 10 am at Kamali Phase III, behind Dubai Estate, Awka, without any justifiable reason. He was subsequently detained for 12 hours, from 10 am to 10 pm, at the Police Rapid Response Squad’s cell in Awkuzu, Anambra State.

According to the court document, Nwosu’s arrest and detention violated his fundamental human rights, as enshrined in the 1999 Nigerian Constitution. His counsel, Joseph O. Eze and Associates, has submitted that the arrest and detention were a clear breach of Nwosu’s rights and has prayed the court to declare the arrest and detention unlawful and award N20 million in compensation for the damages suffered.

The respondent, CSP Ifeanyi Iburu, is accused of abusing his power and violating Nwosu’s rights without any lawful justification. The case highlights concerns about police brutality and the need for law enforcement agencies to respect citizens’ fundamental rights.
