Justice Nwite’s Absence Halts Bail Ruling for Detained Binance Executive

The absence of Justice Emeka Nwite of a Federal High Court in Abuja on Wednesday stalled the ruling on a fresh bail application filed by Tigran Gambaryan, a detained executive of Binance Holdings Limited. The matter was set for ruling on Gambaryan’s bail request but could not proceed as Justice Nwite was attending a seminar at the National Judicial Institute (NJI) in Abuja. Ekele Iheanacho, counsel to the Economic and Financial Crimes Commission (EFCC), vehemently opposed the bail application on September 4, arguing that Gambaryan was receiving the best medical treatment at the Nigerian Correctional Service (NCoS). Iheanacho presented a medical report from the State House Clinic in Abuja, which showed that Gambaryan had rejected medical intervention on one occasion. The lawyer urged the court to dismiss the fresh application.

Iheanacho also provided a report from the Nizamiye Hospital, which was attached to the response received by the National Security Adviser (NSA) on August 29. The report indicated that Gambaryan has been receiving adequate medical care from the NCoS and has been taken to several hospitals, including the State House Clinic. The lawyer insisted that the NCoS has the capacity to take Gambaryan to any hospital in Nigeria and cannot force surgery on him without his consent.

Gambaryan’s lawyer, Mark Mordi, had prayed the court to admit his client to bail on liberal terms or for six weeks based on ill-health. Mordi argued that the exhibits, including medical reports, showed that Gambaryan needed medical care and that his health challenge cannot be adequately managed in Nigeria.

The absence of Justice Nwite’s ruling has delayed Gambaryan’s chances of bail, leaving the EFCC’s detention of the Binance executive in limbo. The case is set to continue on October 11.
