Supreme Court Boosts Local Govts’ Autonomy

Supreme Court Verdict on Local Government Economy: Lawmaker Seeks Enforced Implementation

In a bold move to ensure the financial autonomy of local governments, the lawmaker representing Anambra North in the National Assembly, Tony Nwoye, has called for the enforcement of the recent Supreme Court verdict on local government economy. This declaration comes three months after the Supreme Court granted autonomy to all the 774 local government areas in the country.

In July, the federal government, through the Minister of Justice and Attorney General of the Federation, filed a suit that led to the Supreme Court’s decision. According to Nwoye, the government is now due to receive funds directly from the Federal Government, and he believes that the judgments of the Supreme Court should be obeyed.

“This money that comes from the Federal Government, which the Supreme Court has given judgment directly, we are calling on the Attorney General of the Federation, we are calling on all the security agencies to ensure that the judgment of the Supreme Court is obeyed,” he emphasized.

Nwoye’s call for the implementation of the Supreme Court’s verdict is backed by the Senate, which has resolved to take immediate steps to alter sections of the Constitution to give full autonomy to local government administration in the country. The Senate has also asked state and local governments to immediately comply with the Supreme Court’s judgment, particularly relating to local government accounts and the funds given directly to them.

The Senate’s resolve follows a closed-door session, where lawmakers debated attempts by some state governments to circumvent the Supreme Court’s ruling. The lawmakers are concerned that some state governments are trying to subvert the financial autonomy of local governments by inserting clauses in their laws requiring local governments to remit their allocation from the Federation Account to a dedicated account controlled by the state governments.

The situation has raised many concerns, with the Senate motion emphasizing that this move would undermine the financial autonomy granted to local governments. It is hoped that the Supreme Court’s verdict will be implemented in its entirety, ensuring that local governments can manage their own affairs without interference from state governments.
