Liberia’s Judiciary in Crisis: A Deepening Divide

A significant rift is emerging within Liberia’s judicial system, pitting the Liberian National Bar Association (LNBA) against the Supreme Court of Liberia. The tension escalated when the Supreme Court boycotted the LNBA’s Law Day celebration, following the Bar’s public criticism of the Court’s ruling on the leadership crisis at the House of Representatives. At the heart of the controversy is the Supreme Court’s decision on the Speakership of the House of Representatives, where the Executive, backed by a group of lawmakers, removed Speaker J. Fonati Koffa and replaced him with Richard Nagbe Koon, a ruling party lawmaker. The Court has refused to recognize Koon as the legitimate Speaker, leading to a stalemate. President Joseph Boakai has stated that the Court’s ruling is not enforceable, further exacerbating the situation.

The boycott of the Law Day celebration was a clear indication of the deepening divide between the two institutions. The entire bench of the Supreme Court, including Chief Justice Sie-A-Nyene G. Yuoh, was absent from the event, which was attended by international partners. Former Chief Justice Gloria Musu Scott stepped in to deliver the keynote speech, emphasizing the importance of respecting the Supreme Court’s opinions. "When the Court speaks, it is final!" she stressed, cautioning against politicizing legal institutions.

The situation is alarming, as it suggests that the Executive is attempting to undermine the judiciary’s authority for selfish interests. The LNBA and the Supreme Court must avoid a "tit for tat" scenario, which would only serve to further politicize the judiciary. Instead, both sides should prioritize upholding the sanctity of the legal profession and the Constitution of Liberia.
