Bauchi: PDP clinches Shira council seat as APC boycotts by-election

The Edo State chapter of the Peoples Democratic Party has petitioned the State Police Command, urging restraint from participating in the forthcoming local government by-elections. The petition, written by Dr. Tony Aziegbemi, Chairman of the Edo State PDP Caretaker Committee, cites a recent court order as the basis for this request.

According to reports, the petition is in response to the planned by-elections into 59 wards, organized by the Edo State Independent Electoral Commission. Dr. Aziegbemi’s letter to the Commissioner of Police, dated September 19, 2025, references an order granted by Justice Mary Itsueli of the State High Court, sitting in Benin City. The order, issued on September 17, 2025, in Suit No. B/247M/2025, restrained the Edo State Independent Electoral Commission and the state government from conducting the by-elections, slated for September 20, 2025.

The court order, as cited in the petition, maintains that the tenures of the duly elected councillors in the affected wards remain valid until September 2026. Consequently, any attempt to declare their seats vacant or conduct fresh elections would be deemed unlawful and unconstitutional. Dr. Aziegbemi argues that participation by security agencies in the purported elections would amount to aiding and abetting contempt of court and undermining the rule of law.

The PDP caretaker committee chairman emphasizes the importance of preserving the integrity of democracy, the sanctity of judicial pronouncements, and the credibility of security institutions. He notes that the matter has been referred to the Honourable Chief Judge for assignment to a regular court, with a return date fixed for September 30, 2025.

In light of this development, the Edo State Police Command is expected to refrain from providing security for the by-elections, which are now subject to legal challenge. The situation underscores the complexities of Nigeria’s electoral process and the need for adherence to the rule of law. As the case unfolds, attention will be focused on the forthcoming court proceedings and their potential implications for the democratic process in Edo State.
