The Edo State chapter of the Peoples Democratic Party has petitioned the State Police Command, urging it to refrain from participating in the forthcoming local government by‑elections. The petition, written by Dr. Tony Aziegbemi, Chairman of the Edo State PDP Caretaker Committee, is based on a recent court order.

According to reports, the petition responds to planned by‑elections in 59 wards organized by the Edo State Independent Electoral Commission. Dr. Aziegbemi’s letter to the Commissioner of Police, dated 19 September 2025, references an order granted by Justice Mary Itsueli of the State High Court in Benin City. The order, issued on 17 September 2025 in Suit No. B/247M/2025, restrains the Edo State Independent Electoral Commission and the state government from conducting the by‑elections slated for 20 September 2025. The court maintains that the tenures of the duly elected councillors in the affected wards remain valid until September 2026; therefore, any attempt to declare their seats vacant or to hold fresh elections would be unlawful and unconstitutional.

Dr. Aziegbemi argues that security agencies’ participation in the purported elections would amount to aiding and abetting contempt of court and would undermine the rule of law. He emphasizes the importance of preserving democratic integrity, respecting judicial pronouncements, and maintaining the credibility of security institutions. The matter has been referred to the Honourable Chief Judge for assignment to a regular court, with a return date set for 30 September 2025.

In light of this development, the Edo State Police Command is expected to refrain from providing security for the by‑elections, which are now subject to legal challenge. The situation underscores the complexities of Nigeria’s electoral process and the need for adherence to the rule of law. As the case unfolds, attention will focus on the upcoming court proceedings and their potential implications for the democratic process in Edo State.
