The Federal High Court in Abuja has set June 20, 2022, for the adoption of processes in the suit brought by Nnamdi Kanu, the Leader of the proscribed Indigenous People of Biafra (IPOB), against the State Security Service (SSS). Mr. Kanu had sued the SSS and its Director-General as the first and second respondents in the matter before the court.
The IPOB leader had earlier applied for an order of mandamus to compel the DSS to allow him to have unhindered access to his medical doctor and other requests. The court had granted Kanu permission to apply for the order, but the SSS, in a preliminary objection, stated that the court lacked jurisdiction to hear the suit.
The security outfit pointed out that a judgment had already been delivered in a sister case between Mr. Kanu and the DG of the DSS and two others, which dealt with substantially the same issue of granting Kanu access to his personal physician. The SSS added that Kanu had filed an appeal against the judgment.
During the proceedings, which were adjourned due to the absence of Justice Binta Nyako, the judge warned the lawyers to the SSS and Kanu not to disrupt the proceedings in the next adjourned date. The matter has been fixed for June 20, 2022, for the adoption of applications filed by parties.
It is worth noting that the IPOB leader has been facing charges of treasonable felony in Nigeria since 2015. Mr. Kanu skipped bail after being granted medical leave in 2017, and was subsequently arrested in Kenya and extradited to Nigeria on June 29, 2021. He has since been in detention.
