President Cyril Ramaphosa has acknowledged the recommendations and referrals contained in the second interim report of the Judicial Commission of Inquiry into Criminality, Political Interference and Corruption in the Criminal Justice System, with the latest findings set to feed into ongoing investigations by a specialised South African Police Service task team.
The Presidency confirmed that the commission, chaired by Acting Deputy Chief Justice Mbuyiseli Madlanga, submitted its second interim report on 29 May 2026, following the first interim report delivered on 17 December 2025. The inquiry was established in response to allegations raised by Lieutenant-General Nhlanhla Mkhwanazi on 6 July 2025. A final report is expected on 16 November 2026.
According to the Presidency, the latest report revisits recommendations and referrals made in the first interim report concerning the SAPS. Based on prima facie evidence, and with one exception, the commission confirms its earlier recommendations now that the implicated parties have appeared to give evidence. The report also introduces new recommendations arising from evidence heard since the beginning of 2026.
Flowing from this evidence, the commission recommends disciplinary proceedings and the immediate investigation of alleged criminal conduct against four individuals: Lieutenant General Shadrack Sibiya, a person referred to as Witness G, Sergeant Fannie Nkosi, and Brown Mogotsi. If sufficient evidence exists, the commission further recommends the institution of criminal proceedings.
The commission has also urged that the Office of the Inspector General for Intelligence, or another appropriately authorised functionary, conduct an immediate investigation into alleged off-the-books Crime Intelligence operations involving Mogotsi and Witness G.
These recommendations and referrals were made in accordance with the commission’s terms of reference. Clause 10.4 empowers the body to refer matters for immediate criminal investigation and urgent decisions on prosecution, while Clause 12 authorises referrals for prosecution, further investigation, or separate inquiries to the appropriate law enforcement agency, government department, or regulator.
The Presidency stated that the most recent referrals will be incorporated into the work of the SAPS special investigations task team established after the first interim report. That team was mandated to institute investigations against individuals identified by the commission as a matter of urgency.
