The Kano state government has announced its plan to file an appeal against a recent judgement by the Federal High Court. The court had ordered the government to pay N30 billion in compensation over the demolition of shops at the Kano Eid Ground (Filin Idi).

Governor Abba Yusuf had initiated the demolition of illegal structures, including corner shops at Filin Idi, which the government claimed were acquired illegally. However, the shop owners, represented by the Incorporated Trustees of Masallacin Eid Shop Owners, were dissatisfied with the demolition and took legal action, seeking compensation.

In his ruling, Justice Samuel Amobeda stated that the government did not follow proper constitutional procedures for the demolition. Consequently, he ordered the state government to immediately pay N30 billion to the affected shop owners.

In response to the judgement, the state Attorney General and Commissioner for Justice, Haruna Dederi, criticized the court’s decision. He argued that the court lacked jurisdiction to hear the case but proceeded with the judgement nonetheless. Additionally, Dederi highlighted that the court failed to consider the issue of land ownership during the trial. He stressed that the individuals who sued the government for the demolition did not necessarily prove their ownership of the land on which they built their shops.

Dederi further emphasized that the government had already expressed its objection to the jurisdiction of the High Court. However, in anticipation of the court’s ruling, the government had prepared the necessary documents to appeal the judgement at the Court of Appeal in Kano.

Furthermore, Dederi revealed that the government had filed a separate lawsuit challenging the ownership of the land upon which the demolished corner shops were situated. The case is scheduled to commence next week. Dederi explained that the government’s argument is based on the claim that the land was illegally acquired, emphasizing that such issues are not within the realm of the law.

As the legal battle between the Kano state government and the affected shop owners continues, the government remains determined to pursue its appeal and challenge the ownership of the disputed land.
