EFCC Ordered to Release or Produce Godwin Emefiele by November 8

Justice Olukayode Adeniyi of the FCT High Court has once again instructed the Economic and Financial Crimes Commission (EFCC) to either release or produce former Governor of the Central Bank of Nigeria (CBN), Godwin Emefiele, on November 8. This development follows the initial order issued on Friday, in response to an ex parte motion filed by Emefiele to assert his fundamental rights.

At the resumed hearing on Monday, the EFCC counsel, Farouk Abdullahai, informed the court that the order was not clearly understood and expressed inability to comply. He also pointed out that certain documents were missing from the applicant’s affidavit.

During the proceedings, Matthew Burkaa, SAN, counsel for Mr Emefiele, noted that his client had been in the custody of the Federal Government for a prolonged period of 149 days. He assured the court that the omitted documents, including the charge, would be promptly attached.

In response, Abdullahi clarified that Emefiele had only been in EFCC custody for seven days, despite the extended period mentioned by the applicant’s counsel.

Having considered the submissions of both parties, Justice Adeniyi reiterated his directive for the release of the applicant or his production for bail on Wednesday. Additionally, he ordered Emefiele’s counsel to attach the omitted documents to support their affidavit and serve all relevant parties.
