The All Progressives Congress (APC) has criticized Governor Siminalayi Fubara’s recent presentation of the N800 billion 2024 budget to only four out of the 31 members of the state House of Assembly. This controversial move took place at the Government House in Port Harcourt, shortly after the demolition of the House of Assembly Complex.

Mr. Tony Okocha, the state APC Caretaker Committee Chairman, issued a statement in Port Harcourt, highlighting the unconstitutional nature of the Governor’s actions. Okocha referenced Section 120(2) of the Constitution, emphasizing that no funds should be expended without being appropriated by the state House of Assembly.

“The presentation of a bill to 4 suspended members of the House of Assembly does not fulfil the requirements of the constitution for all the reasons stated,” Okocha expressed in the statement.

Further, Okocha cautioned that any expenditure made by the state government based on this presentation would constitute a clear violation of the constitution, providing sufficient grounds for impeachment. He also cited Section 92(2)C, which outlines the conditions under which a Speaker can be removed by a two-thirds majority of the House of Assembly.

Additionally, Okocha raised concerns about the absence of evidence indicating the removal of Mr. Martins Amaewhule, the Speaker of the House. “Amaewhule remains the speaker of the House of Assembly, as the lawmakers passed a vote of confidence on him,” he asserted.

The APC’s strong condemnation of the Governor’s actions underscores the heightening tensions within the state’s political landscape. This controversial episode raises serious questions about adherence to constitutional protocols and the implications of bypassing established legislative procedures.
