The Appeal Court in Owerri has barred the Independent National Electoral Commission (INEC) and the Peoples Democratic Party (PDP) from conducting a rerun primary election for the Aboh Mbaise/Ngor Okpala federal constituency. This follows a decision by an Abuja federal high court last week, which cancelled the PDP primary that had declared Albert Agulanna the winner and ordered a fresh primary within 14 days.
Justice Rita Pemu, hearing an appeal filed by Uzoma Ugochukwu against the PDP, INEC, Bede Eke and Albert Agulanna, ordered that the proposed rerun primary be halted pending the appeal’s determination before the Supreme Court. She stated:
“Accordingly, it is hereby ordered as follows: the order of this honourable court made on 20 January 2023, directing a fresh primary election for Aboh Mbaise/Ngor Okpala federal constituency of Imo State, is stayed pending the hearing and final determination of the applicant’s appeal before the Supreme Court on the propriety of that order. Consequently, by this order, the first and second respondents are restrained from enforcing in any way whatsoever the judgment delivered on 20 January 2023 by conducting a fresh primary election for Aboh Mbaise/Ngor Okpala federal constituency.”
