Two Yobe APC State Assembly candidates get court order to participate in election

The Federal Court of Appeal sitting in Gombe has granted a stay of execution order to the All Progressives Congress, APC, for its candidates to contest in Fika East and Ngoya/Ngeji state assembly constituencies’ seats.

This was disclosed by the Director-General, Yobe APC Campaign Council, Senator Mohammed Hassan, in a statement made available to Media Talk Africa in Damaturu, the state capital.

He said the court, at its sitting yesterday, took applications for a stay of execution in both appeals and granted the stay of execution order.

“This stay of execution order provides our candidates with the opportunity to participate in the forthcoming state assembly elections”, Sen. Hassan noted.

The DG appealed to APC candidates and their supporters to conduct themselves peacefully and within the confines of the law, expressing optimism that they will emerge victorious in the governorship and state assembly elections.

Recall a Federal High Court in Damaturu had ruled that the APC could not field candidates for the two State House of Assembly seats of Ngalda-Fika and Goya-Ngeji constituencies.

Justice Fadima Aminu pointed out that in October last year, a judge of the court nullified the party’s primaries conducted in both constituencies on 26 May 2022, following non-compliance with Section 84(13) of the Electoral Act 2022, and ordered fresh primaries to be conducted by the party within 14 days as required by law.
