The Court of Appeal in Abuja has dismissed an appeal by Assistant Commissioner of Police Sunday Ubua, who sought admission to bail. Ubua is an associate of the suspended Deputy Commissioner of Police Abba Kyari, and both are being prosecuted by the National Drug Law Enforcement Agency for unlawful drug dealings and related charges.

In a judgment delivered on Friday, a three‑member panel of the appellate court held that Ubua’s appeal was without merit and affirmed the ruling of Justice Nwite, issued on 28 March 2022. That earlier judgment rejected Ubua’s bail application because the prosecution had presented sufficient material to justify the denial.

Justice Stephen Adah, writing the lead judgment, noted that the appellant had not introduced any new evidence that would warrant overturning Justice Emeka Nwite’s decision of the Federal High Court, Abuja. Consequently, the appeal was dismissed.

Ubua remains on trial alongside Kyari and three former members of the Intelligence Response Team, Force Investigation and Intelligence Department of the Nigeria Police Force, facing charges of unlawful drug dealing and attempts to tamper with evidence. Details to follow.
