The Vice Chancellor of Prince Abubakar Audu University, Anyigba, Prof. Marietu Tenuche, has been taken to court over the alleged diversion of N31 million intended for the university’s alumni association. In the first hearing of the suit filed at the Kogi State High Court, Anyigba, the plaintiff—the Prince Audu Abubakar University Alumni Association—sought an interlocutory injunction. The injunction would prevent the university, as defendant, from holding any council meeting without the inclusion of alumni until the substantive matter is heard and determined. The alumni association also requested an order restraining the university from unlawfully withdrawing funds from the banks used for collecting the alumni fund, alleging that more than N31 million had been diverted for other purposes.

The case, identified as suit no. AYHC/03/2023, was heard before Justice F. Ajayi on Friday. Defence counsel, F.O. Ekpa, Esq., applied for a motion on notice to extend the time for filing the defendant’s counter‑affidavit, which the court granted. He also sought relief to file the defendant’s memorandum of conditional appearance and statements of defence, which had been filed out of time; this request was likewise granted.

Subsequently, the defendant lodged a motion of preliminary objection, challenging the claimant’s competency to sue. The court adjourned the matter to May 3, 2023, and ordered the claimant’s counsel, Ibrahim Shuaibu, Esq., to formally respond to the notice of preliminary objection.
