Governor El-Rufai Proscribes Atyap Community Development Association

In a move to ensure the peace and safety of Kaduna State, Governor Nasir El-Rufai has declared the Atyap Community Development Association (ACDA) an unlawful society. The statement was released on Sunday by the Special Adviser on Media and Communication, Muyiwa Adekeye.

According to the statement, the Atyap Community Development Association has become a society that poses a threat to the state’s peace, harmony, and good governance. The governor signed the proscription order under Section 60 of the Kaduna State Penal Code Law No. 5 of 2017 and Section 5 (2) of the 1999 Constitution of the Federal Republic of Nigeria.

The proscription order came into effect on May 24, 2023. However, the statement makes it clear that every citizen has the constitutional right to freedom of thought, conscience, religion, and the freedom of association and peaceful assembly as guaranteed by sections 38 and 40 of the Constitution of the Federal Republic of Nigeria.

Section 45 (1) of the 1999 Constitution empowers the Governor to take necessary measures to protect the public safety, public order, public morality, health, or the rights and freedom of people in Kaduna State.

The proscription order is a bold move by the governor to ensure the safety and security of the state. It serves as a warning to other associations that may attempt to cause disunity and destabilization in Kaduna State.
