Court dismisses suit against Akpabio, Senate, over Natasha Akpoti-Uduaghan's suspension

A federal high court in Abuja has dismissed a lawsuit challenging the six‑month suspension of Senator Natasha Uduaghan‑Apoti, who represents Kogi Central. The suit, filed by Ovavu Illiyasu and nine others, argued that the suspension would unfairly deprive their senatorial district of representation in the Senate and sought to have the court void the penalty.

Justice James Omotosho ruled that the ten plaintiffs lacked the legal standing, or locus standi, required to bring the matter before the court. He emphasized that the plaintiffs failed to demonstrate a direct connection to the issue, a prerequisite for pursuing legal action. Consequently, the judge dismissed the suit for lack of merit.

The case, identified as FHC/ABJ/CS/654/2025, had sought to invalidate the suspension on various grounds, including its impact on the district’s representation. While the suspension of Senator Uduaghan‑Apoti has been controversial, with concerns raised about the rights of legislators and their constituents, the court’s decision indicates that the suspension will remain in effect for now.

The ruling may have implications for the balance of power in the Senate and the representation of Kogi Central, highlighting the complexities of Nigeria’s legal and legislative systems where issues of misconduct and representation intersect. As the country continues to navigate its democratic processes, the judiciary’s role in resolving disputes and interpreting the law remains crucial. The dismissal of the lawsuit could lead to further developments, such as potential appeals or other legal challenges.
