A Benin High Court, presided over by Justice V. O. Oviawe, has adjourned a case of alleged will forgery involving Efosa Uyigue and five others. The suit was brought by thirteen children of the late Edo politician Sunday Aiguobarueghian Uyigue and is now set for hearing on May 18, 2023.
When the case was called for hearing on Wednesday, the respondents’ counsel, Dr. Osagie Obayuwana, requested an adjournment to file his reply. The plaintiffs’ lawyer, Olayinwola Afolabi, did not object, and Justice Oviawe granted the adjournment to the May 18 date.
The thirteen children—including the first son, Osayogie Uyigue, as well as Ehigie Uyigue, Imasuen Uyigue, Agbondinmwin Uyigue, and nine others—have dragged Efosa Uyigue and five additional children before the Edo State High Court in Benin City, alleging forgery of their father’s will. The suit also names the two executors and the Probate Registrar of the High Court of Justice, Edo State, as respondents.
In the suit, marked B/63/2023, the plaintiffs claim that their late father had no legal right to unilaterally devise the properties of Ayore Integrated Farms Limited to any beneficiaries. They seek a declaration that the document dated 4 September 2018, purported to be the “will of our late father Sunday Aiguobarueghian Uyigue” (who died on 26 July 2022 and whose will was allegedly read on 11 November 2022 by the eighth defendant), is null and void.
Specifically, they request:
– A declaration that their father did not make any valid will or testamentary disposition on 18 September 2018;
– A declaration that, in the absence of a valid will, Sunday Aiguobarueghian Uyigue died intestate;
– A perpetual injunction restraining the Probate Registrar of Edo State from issuing a Letter of Administration to any beneficiary under the purported will;
– A perpetual injunction preventing the two executors of the alleged will from acting in any capacity as executors.
