The Peoples Democratic Party (PDP) and its presidential candidate, Atiku Abubakar, have filed a petition with the Presidential Election Petition Tribunal to contest the declaration of Bola Tinubu of the All Progressives Congress (APC) as the winner of the February 25 presidential election. The filing, confirmed on Tuesday evening, is recorded as CA/PEPC/05/2023 and lists Atiku Abubakar and the PDP as petitioners. The respondents, in order, are the Independent National Electoral Commission (INEC), Bola Tinubu, and the APC.
This move follows a similar petition lodged by the Labour Party and its candidate, Peter Obi, which was also submitted to the election petitions tribunal in Abuja. Obi’s petition, marked CA/PEPC/03/2023, names INEC, Tinubu, his running mate Senator Kashim Shettima, and the APC as the first to fourth respondents. The petitioners seek a tribunal declaration that Tinubu was not duly elected by a majority of lawful votes and request an order directing INEC to retrieve the certificate of return issued to the APC candidate and to issue a fresh one to Obi.
INEC Chairman Mahmood Yakubu declared Tinubu president‑elect on March 1, stating that his party secured a majority of votes cast. The announced results show Tinubu with 8,805,835 votes, Atiku Abubakar of the PDP in second place with 6,984,640 votes, and Obi with 6,101,533 votes. More details will follow.
