The Appeal Court in Abuja, sitting on Friday, set aside the judgment of the Osun State Election Petition Tribunal that had annulled Ademola Adeleke’s victory in the July 16, 2022, Osun State governorship election. The tribunal had previously declared Gboyega Oyetola of the All Progressives Congress (APC) the authentic winner, despite the Independent National Electoral Commission (INEC) reporting that Adeleke of the Peoples Democratic Party (PDP) had won the poll with 403,371 votes, defeating the incumbent governor, Adegboyega Oyetola, who received 375,027 votes.
Oyetola and the APC rejected INEC’s result and challenged it before the tribunal. In its majority verdict dated January 27, 2023, the Justice Tertse Kume‑led tribunal annulled Adeleke’s victory and declared Oyetola the winner, while a minority judgment by Justice B. Ogbuli affirmed Adeleke as the victor. Dissatisfied, Adeleke and the PDP appealed to the Court of Appeal.
The Court of Appeal heard the appeal on March 13 and reserved its judgment. On Friday, the appellate court set aside the tribunal’s judgment. After a brief five‑minute recess, the court will reconvene to deliver its final judgment.
