In a significant legal victory, the Federal High Court in Abuja has ruled in favor of Senator Samuel Anyanwu, affirming his position as the valid national secretary of the Peoples Democratic Party (PDP). This landmark judgment carries far-reaching implications for the party’s leadership and governance.

The presiding judge, Justice Inyang Ekwo, issued an injunction restraining the PDP’s national leadership from appointing an acting national secretary while Anyanwu’s four-year tenure is ongoing, in accordance with the party’s constitution, until December 9, 2025. Furthermore, Justice Ekwo declared any attempt to remove Anyanwu from his position as null and void, citing the contravention of the PDP Constitution’s Article 47(1) (as amended in 2017).

The court’s ruling extends to the Independent National Electoral Commission (INEC), prohibiting the recognition of any individual as the national secretary of the PDP, other than Anyanwu. This legal safeguard bolsters the integrity and stability of the party’s organizational structure.

This legal triumph follows a prior court order on November 23, 2023, which halted the PDP from ousting Anyanwu as the national secretary. The interim injunction was granted following an ex-parte motion filed by Dr. Joshua Musa, SAN, on behalf of Geoffrey Ihentuge and Apollo’s Godspower, both esteemed members of the PDP. Their actions underscore the grassroots support for Anyanwu’s continued leadership within the party.

The plaintiffs emphasized that Anyanwu’s election on December 10, 2021, aligns with the party’s constitutional provisions, entitling him to uphold his office until December 9, 2025. This legal precedent serves as a cornerstone for upholding democratic processes and respecting the tenure of elected officials within political organizations.

The case, brought against the PDP, its acting national chairman, National Executive Committee (NEC), National Working Committee (NWC), and INEC, underscores the significance of upholding constitutional principles and preserving the democratic ethos within Nigeria’s political landscape.
