The National Industrial Court sitting in Kano on Monday ordered the Kano State government to maintain the “status quo ante bellum” in a case filed by the sacked chairman of the Kano Public Complaints and Anticorruption Commission, PCAC, Muhuyi Rimingado, pending the hearing of the motion on notice.
Status quo ante bellum means the situation as it existed before the dispute.
The case, filed before Justice E.D. Esele, has the Kano State Government, the State House of Assembly and the Kano State attorney general as 1st, 2nd and 3rd defendants respectively.
Mr Rimingado is challenging the legality of the government’s decision to sack him without recourse to fair hearing.
By this order, the dismissal letter extended to Mr Rimingado is of no effect and the earlier judgement of the National Industrial Court, Abuja stands unless the court rules otherwise after the determination of the case.
On December 14 2022, the National Industrial Court declared Mr Rimingado as the substantive chairman commission, and also ordered Mr Ganduje to pay him salary arrears of N5,791, 891.22.
But in a dismissal letter dated January 24 and signed by the secretary to the state government, Usman Alhaji, the state government sacked Mr Rimingado as the chairman of the commission, citing the July 26 resolution of the State House of Assembly.
