Legislators defecting to another party is unconstitutional - PLAC Executive Director Nwankwo

The Executive Director of the Policy and Legal Advocacy Centre, Clement Nwankwo, has asserted that elected legislators who defect to other political parties are acting contrary to the constitution. He made this statement during an interview on Channels Television’s programme *Politics Today*, where he shared his insights on the issue.

Having been involved in the constitution‑making process since the 1999 constitution of the Fourth Republic, Nwankwo offered a unique perspective. He explained that constant alterations to the constitution often arise because politicians seek ways to subvert existing laws, prompting the need for new measures and provisions to prevent such manipulations. Specifically, he addressed the problem of legislators switching parties, stating that the constitution clearly forbids this practice. According to Nwankwo, a legislator elected under a particular party should not be allowed to defect to another party.

The issue of party defection has long been contentious in Nigeria’s political sphere, with numerous instances of legislators changing allegiance over the years. Nwankwo’s remarks serve as a reminder that political leaders must respect both the constitution and the electoral process that brought them into office. As the country’s political landscape continues to evolve, adherence to constitutional provisions and the promotion of transparency and accountability in governance remain essential.

In the broader context of Nigeria’s political history, the constitution has undergone several amendments aimed at strengthening democratic institutions and promoting good governance. Nwankwo’s involvement in the constitution‑making process has given him a deep understanding of the law’s intricacies and the necessity of respecting its provisions. As the debate on party defection continues, his statement underscores the importance of upholding the constitution and fostering a culture that respects the rule of law.
